歡迎使用 DrummerUpSkill（以下稱「本服務」）。本服務是一個鼓手練習用的網頁／App 工具，由開發者個人維護（非商業公司營運），目前處於測試階段。使用本服務即表示你已閱讀並同意以下條款；如果不同意，請不要使用。
1. 服務內容
本服務提供鼓譜模組編輯、節奏練習與評分、成績單分析，以及登入後的雲端同步與公開分享功能。評分依據的是你的裝置、瀏覽器與音訊系統實際回報的時間，結果僅供練習參考，不代表任何正式的演奏能力評量。
2. 帳號
- 不登入也能使用大部分功能，資料只會存在你的裝置；登入後可同步到雲端，並使用分享功能。
- 你要妥善保管自己的登入方式，並對使用你帳號所做的操作負責。
- 未成年人請在法定代理人同意下使用本服務。
- 你可以隨時在 App 內刪除帳號，做法與刪除範圍見隱私權政策。
3. 你的內容與授權
- 內容歸屬：你建立的鼓譜模組、群組、名稱、描述、分享留言等內容，著作權仍屬於你（或原權利人）。
- 給我們的授權：為了提供本服務，你授權我們在服務範圍內儲存、處理、顯示你的內容（例如同步到雲端、產生成績單、顯示你分享的內容）。
- 你的保證：你保證你有權使用、分享你放進本服務的內容，且不會侵害他人的著作權或其他權利。
4. 公開分享
- 你主動建立分享連結時，內容（包含你選擇公開的分享者資訊與分享留言）會讓任何拿到連結的人看到。詳細內容見隱私權政策。
- 你同意任何拿到連結的人，可以為個人練習的目的檢視、試聽，並把分享的內容匯入自己的模組庫修改使用。
- 對方匯入後，那份副本屬於對方的資料，撤回分享或刪除帳號只會讓連結失效、刪除我們保存的分享文件，無法收回對方已經複製的內容。
- 連結有效期限到期後連結會失效；你也可以隨時在「分享管理」撤回。
5. 使用規範
請不要：
- 分享違法、侵害他人權利、騷擾、歧視、色情或含有惡意程式的內容，包括模組名稱、群組名稱與描述、分享名稱與分享留言等所有文字欄位。
- 冒用他人名稱或頭像，或以誤導的方式呈現分享者身分。
- 干擾、破壞本服務或其基礎設施，例如大量自動化請求、嘗試繞過存取限制、探測或存取不屬於你的資料。
- 利用本服務從事任何違反法律的行為。
我們可以在發現或接獲檢舉違反上述規範時，移除相關分享或內容，並視情況暫停或終止帳號，不另行通知。
6. 訂閱與付費功能
部分功能可能限定於特定訂閱等級。目前訂閱等級由開發者人工設定，尚未串接金流；日後若開始收費，會在開通前另行告知價格與條件。功能內容與開放範圍可能調整。
7. 測試階段與服務變更
本服務目前為測試階段，功能、介面與資料格式都可能改變、暫停或停止提供，我們不保證服務不中斷或沒有錯誤。雲端資料雖然會儘力保存，但仍建議你自行保留重要模組的備份（例如匯出檔案）。
8. 第三方服務與授權
- 本服務使用 Google Firebase 提供登入、資料庫與網站代管；你選擇用 Google、GitHub、Microsoft 登入時，會受該服務自己的條款與隱私政策約束。
- 只有在你同意後，才會使用 Google Analytics 分析使用情況，見隱私權政策。
- 「原音鼓組」「力量搖滾」的取樣改編自 Virtuosity Drums（Versilian Studios × Karoryfer Samples）與 Big Rusty Drums（Karoryfer Samples），皆為 CC0 授權；Splash 鈸取樣例外，授權與署名見下方「素材來源與署名」。其餘音色由程式合成。
素材來源與署名
Splash 鈸取樣來自 CrocellKit（DrumGizmo），採創用 CC 姓名標示 4.0（CC BY 4.0）授權。取樣：Lars Muldjord；鼓組架設：Andreas（Crocell）；麥克風：Jacob Olsen（JBOSound）。DrummerUp 有修改原始素材：多軌麥克風混成立體聲、48 kHz 重取樣為 44.1 kHz、起音對齊、截短淡出、響度平衡、MP3 編碼。
9. 免責聲明
本服務依「現況」提供。在法律允許的範圍內，我們不保證本服務符合你的特定需求，也不對因使用或無法使用本服務所造成的間接、附帶或衍生損害負責（例如資料遺失、練習成果與預期不符）。這項限制不排除法律上不能排除的責任。
10. 終止
你可以隨時停止使用本服務並刪除帳號。我們也可以在你違反本條款、或為了維護服務安全與穩定時，暫停或終止你的帳號與分享。
11. 條款變更
我們可能修改本條款，修改後會更新本頁的「最後更新」日期；重大變更時會在 App 內提示。你在變更後繼續使用本服務，視為接受修改後的條款。
12. 準據法
本條款以中華民國（台灣）法律為準據法；因本條款或本服務發生爭議時，依法有管轄權的法院審理。

Welcome to DrummerUpSkill (the "Service"), a web/app tool for drummers maintained by an individual developer (not a company) and currently in beta. By using the Service you agree to these terms; if you do not agree, please do not use it.
1. The Service
The Service offers pattern editing, rhythm practice and scoring, score-report analysis, and, when signed in, cloud sync and public sharing. Scoring is based on the timing reported by your device, browser and audio system and is for practice reference only; it is not a formal assessment of playing ability.
2. Accounts
- Most features work without signing in, and your data then stays on your device; signing in enables cloud sync and sharing.
- Keep your sign-in credentials safe; you are responsible for activity under your account.
- Minors should use the Service with the consent of a parent or legal guardian.
- You can delete your account in the app at any time; see the Privacy Policy for how and what is deleted.
3. Your content and licence
- Ownership: you keep the copyright in the patterns, groups, names, descriptions and share messages you create (or it stays with the original rights holder).
- Licence to us: to run the Service you allow us to store, process and display your content within the Service (for example to sync it to the cloud, generate reports and show what you share).
- Your assurance: you confirm you have the right to use and share the content you put into the Service and that it does not infringe anyone's copyright or other rights.
4. Public sharing
- When you create a share link, its content (including the sharer information you choose to show and your message) is visible to anyone with the link. See the Privacy Policy for details.
- You agree that anyone with the link may view and listen to it and import it into their own library to edit and use for personal practice.
- Once imported, that copy is the recipient's own data. Revoking a share or deleting your account disables the link and deletes the share documents we hold; it cannot take back what someone has already copied.
- Links stop working after their expiry; you can also revoke them at any time under "Manage shares".
5. Acceptable use
Please do not:
- share unlawful, infringing, harassing, discriminatory, sexual or malicious content, including in any text field such as pattern or group names and descriptions, share names and messages;
- impersonate others or present the sharer's identity in a misleading way;
- disrupt or damage the Service or its infrastructure, for example through mass automated requests, attempts to bypass access controls, or probing or accessing data that is not yours;
- use the Service for anything unlawful.
If we find or receive a report of a violation, we may remove the related shares or content and, where appropriate, suspend or terminate the account without notice.
6. Subscriptions and paid features
Some features may be limited to certain tiers. Tiers are currently set manually by the developer and there is no payment integration yet; if charging begins we will tell you the price and conditions before it takes effect. Features and availability may change.
7. Beta and changes
The Service is in beta: features, interface and data formats may change, pause or stop, and we do not guarantee uninterrupted or error-free service. Cloud data is kept with reasonable care, but we recommend keeping your own backups of important patterns (for example by exporting files).
8. Third parties and licences
- The Service uses Google Firebase for sign-in, database and hosting; if you sign in with Google, GitHub or Microsoft, that provider's own terms and privacy policy apply.
- Google Analytics is used only with your consent; see the Privacy Policy.
- The "Acoustic Kit" and "Power Rock" kits are adapted from Virtuosity Drums (Versilian Studios × Karoryfer Samples) and Big Rusty Drums (Karoryfer Samples), both CC0; the splash cymbal is the exception, see "Credits" below. Other sounds are synthesized.

9. Disclaimer
The Service is provided "as is". To the extent permitted by law, we do not guarantee that it meets your particular needs and are not liable for indirect, incidental or consequential damages arising from using or being unable to use it (for example data loss, or practice results differing from expectations). This does not exclude liability that cannot be excluded by law.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account and shares if you breach these terms or to protect the security and stability of the Service.
11. Changes to these terms
We may amend these terms and will update the "Last updated" date on this page; for material changes we will notify you in the app. Continuing to use the Service after a change means you accept the amended terms.
12. Governing law
These terms are governed by the laws of the Republic of China (Taiwan); disputes arising from them or the Service are heard by the courts with jurisdiction under the law.
